Consumer Health Data Privacy Policy (Washington My Health My Data Act)

While MLT LLC dba Favorite Child Elder Concierge (“we,” “us,” or “our”) do not provide health care as part of our services, we may from time to time collect Consumer Health Data. This Consumer Health Data Privacy Policy (the “Policy”) explains how we collect, use, store, and share “Consumer Health Data.” It also explains the rights Washington consumers have under Washington’s My Health My Data Act (Chapter 19.373 RCW) and how to exercise them.
1. Scope and Key Definitions
Consumer Health Data means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. Depending on the context, this can include health conditions, symptoms, diagnoses, treatments, medications, test results, biometric information, reproductive or sexual health information, genetic information, and precise location information that could reasonably indicate a consumer’s attempt to receive health care services or supplies.
Consumer means a natural person who is a Washington resident or whose Consumer Health Data is collected or processed in Washington, acting in an individual or household context. This Policy does not apply to individuals acting in an employment context.
Note about exemptions: Some types of information may be exempt from the MHMD Act (for example, certain information regulated by HIPAA). If an exemption applies, different rules may apply to that information. If you have questions, contact us using the information in Section 12.
2. Categories of Consumer Health Data We Collect and Why We Collect It
We collect and use Consumer Health Data only with your consent for a specific purpose, or when it’s necessary to provide a product or service you request.
- Health and wellness information you provide (for example, symptoms, health history you choose to share, goals, allergies/sensitivities, or other information you send us). Why we use it: to provide our services, personalize service delivery when appropriate, communicate with you, keep records of the services you requested, and support quality and training.
- Appointment and service information that may reveal health status (for example, service selections, intake responses, or notes needed to provide the service). Why we use it: to schedule and provide services and to provide customer support.
- Body-related measurements (only if you choose to provide them or if they are needed to perform the service). Why we use it: to provide the service and document service outcomes.
- Connected device/app information (only if you connect a supported device or app, and only as described when you connect it). Why we use it: to provide requested features and support service delivery.
- Communications (for example, emails, messages, or call notes that include health-related information). Why we use it: to respond to you, provide customer support, and keep business records.
What we do not do with Consumer Health Data: We do not sell Consumer Health Data. We do not use geofencing around in-person health care facilities to identify or track consumers, collect Consumer Health Data, or send health-related messages or ads. We do not use Consumer Health Data for targeted advertising.
3. Sources of Consumer Health Data
- Directly from you (for example, when you complete an intake form, request services, contact us, or otherwise provide information).
- From your connected devices or apps (if you choose to connect them and authorize sharing).
- From others at your direction (for example, an authorized representative or a service provider you ask to share information with us).
- From our service providers acting on our behalf (for example, booking/scheduling, customer support tools, secure storage providers) to the extent those providers process Consumer Health Data to provide their services to us.
4. How We Share Consumer Health Data
We share Consumer Health Data only (a) with your consent for a specific purpose (and, where required by law, based on a separate consent to share), or (b) when sharing is necessary to provide a product or service you request.
Consumer Health Data we may share: Depending on the service you request and your choices, we may share the categories listed in Section 2 (for example, intake details needed to provide services).
Categories of third parties and affiliates with whom we share Consumer Health Data:
- Service providers (processors) that help us run our business. Current categories: Appointment scheduling; secure cloud hosting/storage; email/SMS communications; analytics (not used for targeted ads based on Consumer Health Data); payment processing; document management/e-signature]. We will update this Policy as these categories change.
- Payment processors (to process payments). In most cases, payment processors do not need Consumer Health Data, but a transaction may sometimes indicate the type of service you choose.
- Professional advisors (for example, legal, accounting, and insurance professionals) when necessary for business operations, compliance, or risk management.
- Other parties at your direction (for example, if you ask us to share information with family members or a third party).
- Legal and compliance disclosures (for example, to comply with law, respond to lawful requests, or protect rights, safety, and security).
- Affiliates: We do not currently share Consumer Health Data with affiliates. If we begin sharing Consumer Health Data with affiliates in the future, we will update this Policy to identify the affiliate(s) by legal name (e.g., “[Affiliate Legal Name 1], [Affiliate Legal Name 2]”) and, where required, obtain your affirmative consent before we share.
As our business evolves, we may use new vendors or service providers. If a vendor needs to process Consumer Health Data, we will share it only as allowed by law (and with your consent where required) and we will update this Policy as needed.
5. Consent (Including How to Withdraw Consent)
When the MHMD Act requires consent, we will ask you before we collect or share Consumer Health Data. When required, consent to share Consumer Health Data will be separate from consent to collect it.
When we ask for consent, we will explain (1) what categories of Consumer Health Data are involved, (2) why we want it and how we will use it, (3) who we will share it with (if applicable), and (4) how to withdraw consent.
How to withdraw consent: You can withdraw consent for future collection and/or sharing at any time using the methods in Section 6. Withdrawal does not change what we already did with your data, but it applies going forward.
We will not unlawfully discriminate against you for exercising your rights under the MHMD Act.
6. Your Consumer Rights Under the MHMD Act
Subject to applicable law, you have the following rights regarding Consumer Health Data about you:
- Confirm and access: You can ask whether we are collecting, sharing, or selling your Consumer Health Data and request access to it. You can also ask for (1) a list of the third parties and affiliates we have shared or sold your Consumer Health Data to and (2) an email address or other online way to contact those third parties.
- Right to withdraw consent: You can withdraw consent from our future collection and sharing of Consumer Health Data about you.
- Delete: You can ask us to delete your Consumer Health Data. If we delete it, we will also notify affiliates, processors, contractors, and other third parties we shared it with (as required by law) so they can act on your request, too.

To protect your privacy, we may need to verify your identity before we act on your request. We will not make you create a new account to submit a request, but we may ask you to use an existing account (if you have one) to help verify your identity.
If the Consumer Health Data you ask us to delete is stored in backups or archives, deletion may take longer while those systems are maintained or restored. In that case, we will complete deletion within six months after we verify your request.
6.2 Refusals and Appeals
If we deny your request, we will explain the basis for the denial and provide instructions on how to appeal our decision. You may appeal by contacting us at Hello@favoriteelder.com with the subject line “MHMD Act Appeal.” We will review and respond to your appeal in accordance with applicable law.
7. Data Security
We limit access to Consumer Health Data to employees, contractors, and service providers who need it to do their work (for example, to provide the service you requested). We use administrative, technical, and physical safeguards that are reasonable and appropriate for the type and amount of Consumer Health Data we handle.
8. Data Retention
We keep Consumer Health Data only as long as we need it to provide services, meet legal requirements, and handle issues like disputes or recordkeeping. You can request deletion at any time as described in Section 6.
9. Processors
When we hire service providers to process Consumer Health Data for us, we require them (by contract) to follow our instructions and limit how they can use the data.
10. Geofencing and Advertising
We do not use geofences around in-person health care facilities to identify or track people seeking health care services, collect Consumer Health Data, or send health-related notifications, messages, or ads. We also do not use Consumer Health Data for targeted advertising.
11. Changes to This Policy
We may update this Policy from time to time. If we do, we will change the “Last Updated” date above. If we want to collect, use, or share new categories of Consumer Health Data, or use Consumer Health Data for a new purpose that is not described in this Policy, we will update this Policy and get your affirmative consent before we do so.

13. Sale of Consumer Health Data
We do not sell Consumer Health Data. If our practices ever change, we will provide the disclosures and obtain any valid authorizations required by applicable law before selling Consumer Health Data.
